Republicans Try to Force DOJ's Hand Amid Hunter Biden Probe

House Republicans on Thursday filed a lawsuit against two Department of Justice (DOJ) officials involved in the agency's probe of Hunter Biden, accusing two attorneys of failing to comply with subpoenas for depositions.

In its complaint, the GOP members of the House Judiciary Committee requested that the court force tax division officials Mark Daly and Jack Morgan to comply with the subpoenas and sit for interviews with the committee.

The suit also contends that Daly and Morgan "have represented that they personally have no objections to being interviewed by the committee," but that the DOJ "has instructed them not to testify."

Newsweek reached out to the DOJ and counsel for the House Judiciary Committee via email on Thursday for comment.

The IRS and DOJ investigated Hunter Biden, son of President Joe Biden, for possible tax crimes. The House Judiciary Committee has since been looking into whether the DOJ has been giving favorable treatment to the younger Biden.

The lawsuit alleges that in spring 2023, "two IRS whistleblowers who were intimately involved in that investigation came forward and exposed several ways that DOJ had deviated from its standard processes during the Hunter Biden investigation."

The filing mentions as one alleged instance of favoritism an agreement Hunter Biden had made with the DOJ, where he would admit that he had committed federal misdemeanor tax crimes. That plea deal eventually fell apart, and the DOJ filed nine federal tax charges against him in December. A month later, he pleaded not guilty to the charges.

Counsel for the House Judiciary Committee added that Daly and Morgan "initially agreed that DOJ should file charges for tax crimes" against the president's son related to 2014 and 2015, but reversed course months later when "they gave a key presentation and argued just the opposite—that Hunter Biden should not be charged for tax crimes related to those years."

House Republicans are also investigating whether President Biden has attempted to influence the investigation into his son. The lawsuit notes that the committee's investigation ties into the GOP-led impeachment inquiry that is assessing whether Biden used his influence to improperly support the business activities of his son, as well as abused his power as president to "impede, obstruct, or otherwise influence investigations into his son."

"To craft effective legislative reforms and to determine whether President Biden has committed an impeachable offense, it must have all the facts," the lawsuit says. "And to uncover all the facts, the Committee requires testimony from both Mark Daly and Jack Morgan, two current or former Tax Division attorneys who have firsthand knowledge of the irregularities in DOJ's investigation that appear to have benefited Hunter Biden."
